Make Homeschool Safe Act

The Make Homeschool Safe Act protects homeschooled children’s right to be safe, to learn, and to access resources. Created by legal experts who were homeschooled, this model legislation is a blueprint for advocates and legislators to create common-sense protections for homeschooled children in their state.

The MHSA was last updated in July 2024. We acknowledge that recommendations within this document need to be updated to reflect the current status of child welfare systems’ practical response capability and outsized impact on families of color, and are working with community experts to realign those aspects of the model legislation. Our updated MHSA will be released in May 2026

Key 2026 Advocacy Issues

  • Supporting legislation to protect public school children from being withdrawn reactively to homeschool during active or substantiated social services investigations. Our analysis of over 500 cases of abuse and neglect in homeschool settings shows that withdrawal from school under these circumstances is a red flag for abuse.

     

  • Supporting legislation that prevents a caregiver from homeschooling if an adult in the household has been convicted of violent crimes against children
  • Supporting legislation that ensures every homeschooled child is assessed in-person by a professional for wellness and educational progress

     

  • Supporting legislation allowing homeschooled children to participate in public school extracurricular activities in their home district
